These terms of use govern your use of the website and all social media pages (including but not limited to facebook, twitter, pinterest, GooglePlus, LinkedIn, Instagram and YouTube) in respect of “The Man That Can” (together referred to as “the Site”). The Site is operated by The Delicatessen Pty Limited (ABN 88 166 115 760) and these terms of use constitute a legal agreement between you and The Delicatessen and its related bodies corporate as defined in the Corporations Act 2001.
  2. By using the Site you agree that you have read and understood and agree to be bound by these terms of use and all applicable laws and regulations. These terms of use may be varied or updated by The Delicatessen at any time and you will be deemed to accept any such changes by continuing to access the Site after the changes have been made. Accordingly, you are required to review these terms of use regularly.
  3. By agreeing to these terms, you also agree to our Privacy Policy which may be viewed on our Site. If you disagree with any of these terms of use or the Privacy Policy, you should discontinue accessing the Site.
  4. The information contained on the Site is intended for general information purposes only. The Delicatessen has made all reasonable efforts to ensure that the information on this website is accurate at the time of inclusion, however there may be inaccuracies and occasional errors for which the Delicatessen apologises. Your use of the Site is entirely at your own risk.
  5. The Delicatessen reserves the right to refuse you access to this site or to limit or customise, in any way, the parts of the Site to which you are given access.
  6. The Delicatessen has the right to change, add to or remove any information or any product or service from the Site at any time, without notice to you.
  7. Your access to the Site, and these terms of use is governed by the laws of New South Wales, Australia and you submit to the exclusive jurisdiction of the courts of New South Wales and courts with jurisdiction to hear appeals from those courts.
  8. The materials displayed on the Site, including without limitation all editorial materials, information, photographs, illustrations, artwork and other graphic materials, and names, logos and trade marks, are the property of The Delicatessen and are protected by copyright, trade mark and other intellectual property laws. Any such content may be displayed and printed solely for your personal, non-commercial use within your organisation only provided that any copyright notice on such a display or page is not removed. You agree not to reproduce, retransmit, distribute, disseminate, sell, publish, broadcast or circulate any such material to any third party without the express prior written consent of The Delicatessen.
  9. Save for the above, and unless expressly granted, The Delicatessen does not grant any licence or right in, or assign all or part of, its intellectual property rights in the content or applications incorporated into the Site or in the user interface of the Site.
  10. To the maximum extent permitted by applicable laws The Delicatessen has no liability of any kind to you or any other person for any Liability or Claim arising from the use of the Site of any kind whatsoever arising directly or indirectly (whether under statute, contract, tort, negligence or otherwise) in relation to any indirect or consequential loss (including but not limited to any loss of actual or anticipated profits, revenue, savings, production, business, opportunity, access to markets, goodwill, reputation, publicity, or use) or any other remote, abnormal or unforeseeable loss or any similar loss whether or not in the reasonable contemplation of the parties. For the purpose of this clause:
    • Claim” means any actual, contingent, present or future claim, demand, action, suit or proceeding for any Liability, restitution, equitable compensation, account, injunctive relief, specific performance or any other remedy of whatever nature and however arising, whether direct or indirect, and whether in contract, tort (including but not limited to negligence) or otherwise; and
    • Liability” means any loss, liability, cost, payment, damages, debt or expense (including but not limited to reasonable legal fees).

The Delicatessen provides the Site ‘as is’ and all information on the Site is provided without any warranty, express or implied (including without limitation implied warranties of merchantability or fitness for purpose or non-infringement) in relation to any products or services referred to or offered on the Site.
  12. You must not use information from the Site or post information onto the Site which would infringe any intellectual property rights including but not limited to any copyright or trademarks of any third party, or which is unlawful, defamatory or obscene or which would involve illegal acts or breach the laws of any country. The Delicatessen reserves the right to take any steps necessary to remove such material from the Site.
  13. You indemnify The Delicatessen for any loss or damage it suffers as a result of any use you make of the information on the Site or any site referred to or linked to the Site.
  14. You grant The Delicatessen an irrevocable, worldwide, fee free licence to use, reproduce, modify and sublicense, for any purpose and in any way without any restriction, any material you post onto or otherwise transmit to the Site.
  15. You acknowledge and warrant to The Delicatessen that any information you post on or transmit to the Site may be used by The Delicatessen in any manner it sees fit in a consolidated non-identifiable manner.

  17. The Site may require you to register information with The Delicatessen as a condition of access. You must supply accurate and truthful information when requested by The Delicatessen. You indemnify The Delicatessen for any liability, loss or damage or any kind, including costs and expenses, resulting from your failure to properly provide accurate and truthful information for the purpose of registration with The Delicatessen or the Site.
